It is not necessary to prove fault to file for divorce. Different states have different residency rules. For example, you need to be a Kansas resident for at least 60 days before you can file for divorce in Kansas. In Missouri, it is 90 days. There are also rules as to how long the divorce must be pending before the court can grant it.

After the divorce petition is filed, the other spouse must receive proper notification. There are many ways to accomplish this, including hiring a process server. The receiving spouse can sign a Waiver or an Entry of Appearance.

If you and your spouse do not agree on all the issues, you have to go to the court and have the judge decide on the matters. You will most likely have to pay for your own attorney’s fees and expenses. An attorney cannot represent both parties to the divorce. The legal cost will depend on the complexity and particular facts of your case. You are not required to hire an attorney, but there are disadvantages to self-representation in a divorce proceeding. You are held to the standard as an attorney in court and you are expected to know the statutes and case laws.

Court can grant temporary maintenance when the divorce is pending. The final court order will address custody and support of minor children.
